If your order is cancelled after payment has been processed, we will issue a full refund to your original payment method.

 

Indemnification

You agree to defend, indemnify, and hold harmless Kratombloom, its affiliates, officers, directors, employees, agents, suppliers, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorney’s fees) arising from: (a) your use of and access to the Website; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, trademark, trade secret, or other intellectual property or proprietary right, or right of privacy or publicity; (d) your use or misuse of any products purchased from Kratombloom; or (e) any claim that your use of the Website or products caused damage to a third party.

This indemnification obligation will survive the termination of your relationship with Kratombloom and your use of the Website. Kratombloom reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with Kratombloom in asserting any available defenses. You agree not to settle any such claim without the prior written consent of Kratombloom.

 

Shipping and Delivery

Kratombloom ships products to addresses within the United States. Shipping methods, timeframes, and costs vary depending on the destination, product type, and selected shipping option. Estimated delivery times are provided at checkout and are approximate only; we are not responsible for delays caused by carriers, weather, natural disasters, or other circumstances beyond our control.

Risk of loss and title for all products purchased from Kratombloom pass to you upon delivery to the shipping carrier. You are responsible for providing an accurate and complete shipping address. Kratombloom is not responsible for orders delivered to incorrect addresses provided by the customer or for packages refused by the recipient.

For Live Plants & Fresh Flowers, we take special care in packaging to ensure safe delivery; however, we cannot guarantee that plants will arrive in perfect condition due to the inherent risks of shipping living products. Please inspect your shipment immediately upon arrival and contact us within 48 hours if there are any issues.

Undeliverable packages returned to Kratombloom due to incorrect addresses, refusal of delivery, or failure to claim packages will be subject to return shipping fees and restocking fees. If you need to change your shipping address after placing an order, contact us immediately at info@getkratombloom.com or (254) 643-1708. We cannot guarantee address changes after orders have been processed.

 

Return Policy

Kratombloom wants you to be satisfied with your purchase. If you are not completely satisfied with your order, you may return eligible products within 30 days of delivery for a refund or exchange, subject to the conditions outlined in this section.

To be eligible for a return, products must be unused, unopened, in original packaging, and in resalable condition. Due to the nature of our products, the following items are NOT eligible for return or refund: Live Plants & Fresh Flowers (perishable items), opened Herbal Softgels or Culinary Spice Powders (consumable products that have been opened or used), and custom or special orders.

Returns shipped without authorization may not be accepted. Customers are responsible for return shipping costs unless the return is due to our error or a defective product.

Refunds will be processed to the original payment method within 7-10 business days after we receive and inspect the returned product. Refunds will include the product cost but exclude original shipping charges. Exchanges are subject to product availability. If you receive damaged or defective products, contact us immediately with photos for expedited resolution.

 

Limitation of Liability

To the fullest extent permitted by applicable law, Kratombloom, its affiliates, officers, directors, employees, agents, suppliers, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from: (a) your access to or use of or inability to access or use the Website; (b) any conduct or content of any third party on the Website; (c) any content obtained from the Website; (d) unauthorized access, use, or alteration of your transmissions or content; or (e) use or effects of any products purchased from Kratombloom, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

In no event shall Kratombloom’s total liability to you for all damages, losses, or causes of action exceed the amount you paid to Kratombloom for products in the six (6) months prior to the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations and exclusions may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

If you create an account on our Website, you are responsible for maintaining the confidentiality of your account password and for all activities under your account. Notify us immediately of any unauthorized use of your account.

 

Dispute Resolution and Governing Law

These Terms and any dispute or claim arising out of or related to these Terms, the Website, or products purchased from Kratombloom shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any legal action, suit, or proceeding arising out of or relating to these Terms or the Website must be instituted exclusively in the federal or state courts located in Eastland County, Texas. You waive any objection to the jurisdiction of such courts and to venue in such courts.

Before filing any legal action, you agree to first contact Kratombloom at info@getkratombloom.com to attempt to resolve the dispute informally. We will work in good faith to resolve any disputes amicably. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue formal legal action.

You agree to bring any claim or dispute on an individual basis only and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. You waive any right to participate in a class action lawsuit or class-wide arbitration against Kratombloom.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

 

Ordering and Payment

All orders are subject to acceptance by Kratombloom. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, pricing errors, suspected fraud, or violation of these Terms.

You will receive an order confirmation email after placing your order; however, this confirmation does not constitute our acceptance of your order. Acceptance occurs when we ship your order or send you a shipment confirmation email, whichever comes first.

Kratombloom accepts payment via major credit cards, debit cards, and other payment methods displayed at checkout. By providing payment information, you represent and warrant that you are authorized to use the payment method and authorize Kratombloom to charge the full amount of your order, including products, shipping, taxes, and any applicable fees.

All payments are processed securely. Payment authorization is obtained at the time of order placement. If payment cannot be authorized or charged, we will contact you using the information provided, and your order may be cancelled.
